General terms and conditions of sale

Article 1: Application of the GTC
The fact of placing an order for a good on the site Parasol-pro.co.uk or on one of the sites of the company Inspiraction Développement Sarl implies the full and entire adhesion of the customer to these general conditions of sale.
No special condition of the customer can, unless formally accepted in writing by Inspiraction Développement Sarl, prevail over these terms and conditions. Any condition to the contrary will therefore be unenforceable against Inspiraction Développement Sarl, in the absence of express acceptance, regardless of when it may have been brought to its attention.
Inspiraction Development Ltd. is entitled to make changes at any time, changes to these general conditions of sale. The applicable terms and conditions will be those in force on the date of receipt of the order.
The fact that Inspiraction Development Ltd. does not prevail at a given time of any of these general conditions of sale shall not be construed as a waiver to rely on it later.
Inspiraction Développement Sarl will be committed to execute the order only after acceptance by it of the customer's order, confirmed by email sent to the customer.

Article 2 : Products available on the site
The Parasol-pro.co.uk site allows you to purchase parasols, tents and other terrace and garden equipment products manufactured by supplier companies.
Only the manufacturers are responsible for the quality of the products available on the Parasol-pro.co.uk website. Inspiraction Développement Sarl disclaims any responsibility for any defect in the quality of products or their packaging.
The products are offered within the limits of available stocks on the day of acceptance of the order.
If one of the products was no longer available at the time of shipment (out of stock, stop marketing the product, etc..), Inspiraction Development Ltd. will offer another product to the customer or refund the payment made.
The product catalog of the company Inspiraction Développement Sarl is likely to change constantly.
The photos used on the site are non-contractual.

Article 3: Rates in force  
Prices on the site Parasol-pro.co.uk are expressed in euros excluding VAT and include VAT and correspond to the rate in effect on the day of the order.
In all cases, invoices will be dated the day of purchase.
Catalogue prices are given excluding tax and for information only. They may be modified at any time, according to market developments and the availability of products and services desired by the customer.
Inspiraction Développement Sarl guarantees only the price to the buyer on the day of order confirmation.
The products remain the property of Inspiraction Développement Sarl until full receipt of their sales price.

Article 4: Delivery

Terms and Conditions
Delivery will be made to the place previously determined by the buyer on the site Parasol-pro.co.uk. We deliver in Metropolitan France, Corsica, DOM-TOM (on estimate), Italy, UK, Spain, Belgium, Luxembourg and on estimate for other countries.
The order will be delivered at the entrance of your house or at the main door of the building. The deliveryman will not be able to assist you in the handling of the article (to go up floors for example) for insurance and liability reasons.
If the customer refuses or does not take delivery of the product ordered or if the delivery can not be made because of bad or incomplete information provided by the buyer, or an impossible access by semi-trailer to the address indicated, Inspiraction Développement Sarl is entitled to claim immediate and full payment of all additional costs resulting from the refusal of acceptance or failure to receive the said delivery.
The products sold by Inspiraction Development Ltd. travel in all cases at the risk of the customer who is responsible for making any claim under the provisions of Article 5 below.

Deadlines
Deliveries are made only according to the availability of products or services, in the order of arrival of orders and within the time limits contractually established by Inspiraction Développement Sarl.
Inspiraction Development Ltd. can not be held responsible or liable for late penalties or compensation of any kind whatsoever, in case of delay or non-delivery of products and / or services for circumstances beyond its control.

Article 5: Receipt of products
Upon receipt of your purchase, we ask you to systematically check the condition of the goods in the presence of the delivery people BEFORE signing the transport voucher.
Only the strict respect of the following procedures by the recipients will be recognized by our company:
1. Mention precisely any reservation, any incident or any defect on the carrier's delivery slip. In case of apparent damage, write at least: "Packaging damaged, damaged goods", do not write "subject to unpacking" which has no legal value, add your signature and the date. It is recommended to take photos.
2. It is imperative that you confirm your reservations by registered letter addressed to the carrier within a maximum of 3 working days following receipt of the goods (in accordance with article L133-3 of the French Commercial Code), the postmark being taken as proof.
Only these 2 conditions combined can make your claim valid, no claim will be taken into account if nothing is stipulated on the transport voucher.
3. If the deliveryman refuses to give us time to check the goods, mention it in full on the transport voucher ("The driver does not give us time to check the goods") and have it signed by the latter.
4. If necessary, you may refuse the goods, always stating your precise reservations in writing on the transport receipt. Do not forget to confirm by registered letter with AR to the carrier within 3 days to take charge of the dispute. A non-reasoned refusal is not admissible.
5. Inform us as soon as possible by e-mail, sending us a copy of the documents (delivery note, registered letter, photos, etc.) so that we can solve the problem.

Article 6: Right to personal information
Personal data collected by Inspiraction Développement Sarl may be transferred to third parties.
The buyer has a right of access and rectification of personal data concerning him, upon request addressed to Inspiraction Développement Sarl at the following address:

Article 7: Applicable law and jurisdiction
French law is the only law applicable to these general terms and conditions of sale.
Any dispute of any nature whatsoever, as well as any dispute relating to the formation or execution of the order or these general conditions of sale shall be submitted to the competent courts of Caen to which jurisdiction is expressly assigned.
This clause shall apply even in the event of summary proceedings, incidental claims, multiple defendants or third party claims, and whatever the method and terms of payment, without any clauses that may exist in the customer's general terms and conditions being able to prevent the application of these provisions.

Article 8: Right of withdrawal
The customer has a period of 14 clear days from the delivery of his order to return a product. Products must be in their original packaging and in perfect condition. The customer must inform the company Inspiraction Development by mail and indicate the reason for the return. A return number will then be assigned to him that it should appear on the package so that it can be easily identified. The address to which he must make this return will then be indicated. Once the product is received, checked and in good condition, the company undertakes to reimburse the customer by check within 10 days.

However, pursuant to Article L121-20-2 of the Consumer Code, the right of withdrawal may not be exercised in connection with the supply of goods made to the consumer's specifications (this is the case for all orders of acrylic canvas parasols and the entire range of Scolaro, Umbrosa or Prostor).
